Esther Kiobel, the widow of Barinem, and the other plaintiffs in the Kiobel v. Shell case hope to prove in U.S. courts under the Alien Tort Statute (ATS) that Shell was complicit in human rights abuses against the Ogoni people. Their lawyers argue that the ATS allows foreigners to bring civil suits against corporations to U.S. courts for violations of international law.
